TERMS & CONDITIONS

 

 PAYMENTS: 

  1. Memberships: the client will complete a direct debit authority online, and select a preferred membership. The funds will be deducted from the nominated bank account.

  2. Class packs: the client will purchase online using a debit or credit card and select the preferred class pack. The client acknowledges that the class pack begins from the date of first booking, and acknowledges the specified time frame they must use the class credits within.

  3. The client acknowledges that for class packs and memberships only, their class credit will be refunded if they cancel their class before the 12 hour cancellation period.

  4. The client acknowledges that drop in casual classes are non-refundable after the class booking has been made, they are unable to change their class booking around via our online systems, and the 12 hour class cancellation window does not apply to drop in casual classes.

  5. The client acknowledges that all 6-month and 12-month memberships will auto-renew at the expiry of the term. If the client does not wish to auto-renew their membership and wishes to terminate their membership at the end of the 6-month or 12-month term, they must email CLUTCH Reformer Pilates 1 month in advance at emma@clutchstudios.co.nz.

  6. The client agrees to pay all applicable fees by the due date. If a payment is dishonored, the client will be notified and will have 3 days to remedy the default.

  7. Failure to make a payment may result in a late payment fee from CLUTCH Reformer Pilates. CLUTCH Reformer Pilates will not take responsibility for any charges from the bank because of a late payment.

  8. The client acknowledges that CLUTCH group may, in its absolute discretion, amend the prices for goods and services. Unless otherwise specified, all prices for goods and services are inclusive of GST. 

MEMBERSHIP HOLDS:

  1. Clutch Reformer Pilates does not offer open ended holds. The client is to complete a hold form that will state a start and finish date, or provide the start and finish date in an email to Clutch Reformer Pilates via the following email <emma@clutchstudios.co.nz>. After this date, the client's payment plan will continue as per their payment plan schedule.

  2. The client may freeze their membership for the following periods depending on their membership type: 

  3. Monthly rolling membership: The client may freeze their membership for a maximum period of 8 weeks per year.

  4. 6-month membership: The client may freeze their membership for a maximum of period of 4 weeks over the 6 month term 

  5. 12-month membership: The client may freeze their membership for a maximum period of 6 weeks per year.

  6. At least 1 weeks written notice is required for membership pause suspensions. This ensures that the correct measures are put in place to cease direct debit payments that are scheduled for the given period. Written notice must be given via email. Note: social media communications are not a valid method of pausing membership.

MEMBERSHIP OPTIONS 

  1. The minimum membership period for all memberships (including Monthly rolling membership) is 4 weeks. 

  2. All memberships are billed on a fortnightly basis, and credits will be allocated over that fortnight and must be used within that fortnight. It is the members responsibility to know their billing cycle dates and therefore book their membership class credits within these dates. This information can be found in the profile section of the CLUTCH App.

  3. All 4 class/week membership options give the client access to up to 8 classes over the members specific fortnightly billing period. If the client does not use the allocated 8 classes during the fortnight, these credits will expire and the client cannot use them in subsequent weeks.

  4. All 3 class/week membership options give the client access to up to 6 classes over the members specific fortnightly billing period. If the client does not use the allocated 6 classes during the fortnight, these credits will expire and the client cannot use them in subsequent weeks.

  5. All 2 class/week membership options give the client access to up to 4 classes over the members specific fortnightly billing period. If the client does not use the allocated 4 classes during the fortnight, these credits will expire and the client cannot use them in subsequent weeks.

  6. If the client chooses a fixed-term membership option, the contract cannot be canceled until expiry unless due to injury or illness. In these circumstances a medical certificate must be provided. 

  7. Annual/short term fees paid in advance cannot be refunded under any circumstances. 

  8. All memberships operate on a 14 day direct debit schedule via Glofox (a secure system). Payment will continue unless notified of a termination request in writing (see Termination Policy below). 

  9. The client will not be refunded under any membership option for not using their weekly allocated classes. 

  10. Classes are not transferable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own classes or membership. 

  11. Membership fees and other fees are reviewed periodically. CLUTCH group may amend these Terms and Conditions at any time by written notice published on their website, operable from the date specified. The client will be given 14 days' notice of any changes to the members email provided.

  12. You acknowledge and agree that passes are not refundable, extendable, or transferable unless otherwise agreed by CLUTCH group.

  13. It is at the discretion of CLUTCH Reformer Pilates whether they run class, if any, on public holidays. 

  14. The client agrees to pay the below membership price, applicable to their selected membership: 

  15. 3 class/week Month to month membership: $68/week

  16. 3 class/week 6-month membership: $64/week

  17. 3 class/week 12-month membership (opening special): $60/week

  18. 2 class/week Month to month membership: $48/week 

  19. 2 class/week 6-month membership: $44/week

  20. 2 class/week 12-month membership $40/week

  21. 4 class/week month to month membership: $96/week

  22. 4 class/week month membership: $88/week

  23. 4 class/week 12-month membership: $80/wk

  24. All 6-month and 12-month memberships will auto-renew at the expiry of the term. If the client does not wish to auto-renew their membership and wishes to terminate their membership at the end of the 6-month or 12-month term, they must email CLUTCH Reformer Pilates 1 month in advance at emma@clutchstudios.co.nz.

  25. Casual drop in classes are $35/class. The client must book prior to attending to ensure there is space available in the class. 

  26. 3-month 10 class pass is $280 and must be used within 12 weeks of date of fist class booking.

  27. 1-month 10 class pass is $230 and must be used within 1 month of date of first class booking.

  28. The Intro Offer is only available to brand new clients. This offer is non refundable and non transferable. This offer can only be used once per customer. The intro offer is always subject to availability, and is not always available to purchase.

MEMBERSHIP CANCELLATIONS

  1. The following cancellation policies apply to each membership. Fixed term contracts only allow cancellation due to illness/injury or extreme circumstances. It is important that clients select a membership that best suits their needs. 

  2. Month to month: 4 weeks notice to cancel required. The client is to complete a cancellation form or email their cancellation notice to <emma@clutchstudios.co.nz>.

  3. 6-month: Cancellation only allowed due to injury/illness or extreme circumstances. A medical note must be provided. 

  4. 12-month: Cancellation only allowed due to injury/illness or extreme circumstances. A medical note must be provided. 

BOOKING CLASSES

  1. It is important that the client follows booking rules and etiquette.

  2. The client is to book their space in the class online, either via the CLUTCH website, or via the CLUTCH App. 

  3. If the client has to cancel their class, they will do so online also. If the client cancels within the class cancellation window, their credit for the class will not be able to be used again that week. Drop in casual classes are non-refundable and the cancellation window does not apply to them.

  4. CLUTCH Reformer Pilates has small and intimate classes, so it is very important that clients are considerate of booking etiquette so fellow members do not miss out on classes. 

  5. Cancellation windows are subject to change at the discretion of CLUTCH Reformer Pilates. 

  6. If the class you wish to attend is full, you can sign up for the waitlist. Should a place become available you will receive either an email or text offering you a place in the class. You are not obligated to take the place in the class, but please respond if you can make it or not so your place can be offered to another member if you cannot make it. 

  7. Payment must be made prior to booking. To book into a class you must either have pre-purchased sessions in your account or pay at the time of booking in the studio. 

  8. By booking into a class you automatically agree to these Terms and Conditions 

 CLASS CANCELLATION WINDOWS 

  1. It is very important that members respect our class cancellation windows. Our classes are small and intimate, and we want to give everyone equal opportunity to get their weekly classes in! 

  2. Memberships and class packs: Cancellations made more than 12 hours before the class start time will get the class credit back. 

  3. Memberships and class packs: Cancellations made less than 12 hours prior to class start time will forfeit that session. No shows and absences will forfeit that session. 

  4. Casual drop in classes: these are non-refundable and the cancellation window does not apply, you will be unable to cancel your class after you have made the booking.

GENERAL

  1. Out of consideration for the trainer and other clients, please don’t be late. If you are more than 2 minutes late for class, your spot may be given to a waitlisted or stand-by client and your class will be non refundable.  

  2. Late arrivals may be denied entry at the discretion of the trainer. 

  3. Gift cards can be used for classes and products. They are not redeemable for cash and are non transferable. CLUTCH Reformer Pilates does not offer refunds, transfers, suspensions or extensions on Gift Cards for any reason. 

  4. First timers attending their first class must arrive at least 5-10 minutes before the scheduled start time so the trainer can familiarize them with the reformer. 

  5. If the minimum number of clients per class is not met, CLUTCH reserves the right to cancel the class. The studio will contact booked clients in the case of a class cancellation. 

  6. Trainers and classes are subject to change without notice. 

  7. The minimum age for participating in a CLUTCH Reformer Pilates class is 16 years. Exceptions on a case-by-case may apply. 

  8. Should you contract a disease of an infectious or contagious nature, please consult your doctor to ensure you are fit to attend your next class and are not at risk of infecting others. This is for the safety and well-being of all our clients and staff. 

PRIVACY 

  1. The client agrees that CLUTCH group may collect, store and use your personal information. Any personal information will only be accessible by CLUTCH Reformer Pilates staff primarily in the interest of ensuring our clients health and wellbeing. 

INDEMNITY 

  1. CLUTCH Reformer Pilates shall NOT be liable or responsible for any direct, indirect, or consequential injury, loss or damage to the person or the property of any participant at CLUTCH Reformer Pilates, one off training events, one-one training products or any other service of a similar nature. 

  2. All personal property is the responsibility of the individual and CLUTCH Reformer Pilates accept no liability for any loss or damage. Lockers are available for when the client is training, items left for longer than the client's session will be placed into the lost property and eventually discarded if not collected.

PHOTOGRAPHY

  1. Classes may be recorded by the Instructor for quality control, as well as promotional purposes. If you do not consent to the Instructor using video or still images taken during the class for promotional purposes, please notify the Instructor in writing. 

  2. All signatories to this agreement give permission for CLUTCH Reformer Pilates or any licensed provider to use their image for marketing purposes.
